SERVICE AGREEMENT
This Service Agreement ("Agreement") is entered into between RPS Protection & Coatings ("RPS," "we," "us," or "our"), located in Selbyville, Delaware, and the customer requesting services ("Customer," "you," or "your"). By scheduling, authorizing, or paying for services with RPS, you agree to the terms below.
1. SERVICES
RPS provides marine paint protection film (PPF), ceramic coating, outboard protection, and electronics protection services for boats and marine vessels. The specific scope of work, materials, and pricing for your vessel will be detailed in your written estimate or invoice, which is incorporated into this Agreement by reference. RPS is an authorized XPEL dealer and uses XPEL film and coating products unless otherwise specified.
2. Estimates and Pricing
All quotes are estimates based on the information and vessel condition known at the time of quoting. Final pricing may be adjusted if the scope of work changes once the vessel is inspected in person, or if hidden damage, prior repairs, or surface issues are discovered during preparation. RPS will notify you of any pricing changes before proceeding with additional work.
3. Scheduling and Vessel Drop-Off
Customer is responsible for delivering the vessel to RPS's facility at the scheduled time, in a reasonably clean condition suitable for inspection and film/coating application. RPS reserves the right to reschedule or adjust timelines due to weather, material availability, or unforeseen circumstances, and will communicate any changes as soon as possible.
4. Payment Terms
[Insert deposit requirements, accepted payment methods, and balance-due terms — e.g., "A deposit of ___% is required to schedule service, with the remaining balance due upon completion before the vessel is released."]
5. Warranty
[Insert warranty terms here — many PPF/ceramic coating shops pass through the manufacturer's warranty (e.g., XPEL's film warranty) in addition to any workmanship warranty RPS offers on installation. Confirm exact warranty length, coverage, and exclusions with XPEL's dealer terms and RPS's own policy before publishing.]
6. Customer Responsibilities
Customer agrees to follow all post-installation care instructions provided by RPS (such as cure times before washing, recommended cleaning products, and avoiding abrasive materials) to maintain the integrity of the film or coating and any applicable warranty.
7. Limitation of Liability
RPS will perform all services with reasonable care and in accordance with industry standards. RPS is not responsible for pre-existing damage, defects in materials beyond our control, or issues arising from improper care after the vessel leaves our facility. [Consider adding a liability cap or exclusion clause here — this is the section most worth having an attorney review.]
8. Cancellations
[Insert your cancellation/rescheduling policy — e.g., notice required, deposit refundability.]
9. Governing Law
This Agreement is governed by the laws of the State of Delaware.
10. Acceptance
By approving an estimate, submitting a deposit, or authorizing RPS to begin work, Customer acknowledges they have read, understood, and agreed to this Service Agreement.
