Top Coat Performance Terms of Service
Welcome to Top Coat Performance. These Terms of Service (“Terms”) govern your access to and use of our vehicle protection and detailing services (“Services”). By booking or using our Services, you agree to comply with these Terms. If you do not agree, please refrain from using our Services.
1. Scope of Services
Top Coat Performance provides professional automotive protection and styling services, including Paint Protection Film (PPF), Ceramic Coating, Window Tinting, and detailing. All services are subject to availability, vehicle condition, and shop location.
Eligibility to Use Services
To use our Services, you must:

Be at least 18 years old or have the consent of a legal guardian

Provide accurate and complete information at the time of booking

Follow all care and maintenance guidelines provided post-service
We reserve the right to refuse service at our discretion.
3. Vehicle Acceptance Policy
Certain vehicle conditions may affect service eligibility or results. Before beginning any work, our team may evaluate paint quality, contamination, prior coatings, damage, or other factors that could impact results. If additional preparation (such as paint correction or decontamination) is required, we may recommend or require these services at an additional cost.
Customers should disclose any prior treatments, repairs, or known issues before their appointment. Services may be declined or modified if a vehicle’s condition prevents proper application or risks further damage.
4. Pricing and Payments
Prices are based on service type, vehicle size, condition, and any upgrades or add-ons selected. A deposit may be required to secure your appointment. Final payment is due upon service completion. Additional charges may apply for unexpected labor, materials, or changes made by the Customer.
5. Cancellations and Refunds
You may cancel or reschedule your appointment up to 24 hours in advance without penalty. Late cancellations, no-shows, or missed drop-offs may result in forfeited deposits or cancellation fees. Refunds for dissatisfaction, damage, or warranty claims will be reviewed on a case-by-case basis, subject to the limitations in Section 6.
6. Liability and Limitations
Top Coat Performance takes pride in delivering high-quality work. However, we are not liable for:

Pre-existing damage to paint, trim, or aftermarket parts

Issues arising from improper vehicle care after service

Environmental damage (e.g., rock chips, bird droppings, UV damage) beyond the control of any coating or film
Unless otherwise stated in writing, our liability is limited to the total amount paid for the service.
7. Customer Responsibilities
By using our Services, you agree to:

Disclose all known issues with your vehicle’s paint or prior treatments

Provide timely access to your vehicle and ensure it is in a serviceable condition

Follow aftercare instructions and warranty maintenance guidelines
Failure to meet these responsibilities may void warranties or impact service quality.
8. Privacy and Data Protection
Top Coat Performance respects your privacy. Customer data is collected only for booking, communication, and service purposes. We do not sell or share personal information, except as required by law. Please see our Privacy Policy for details.
9. Termination of Services
We reserve the right to suspend or terminate service if:

Your actions compromise the safety of our team or equipment
Termination may occur without notice in severe cases.
10. Intellectual Property
All website content, branding, and marketing materials — including logos, graphics, text, and images — are the property of Top Coat Performance or its licensors. Unauthorized use, reproduction, or distribution is prohibited.
11. Indemnification
You agree to indemnify and hold harmless Top Coat Performance, its employees, and affiliates from any claims, damages, or losses arising from your use of our Services or breach of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved under Texas law in the appropriate state or federal courts.
13. Updates to Terms
Top Coat Performance may update these Terms as needed to reflect changes in services, policies, or legal requirements. Continued use of our Services after updates are posted constitutes acceptance of the revised Terms.
